THE Panlilio-led Boulevard Holdings Inc. on Friday said it is filing a complaint to prevent its Friday’s Resort property in Boracay Island in Aklan from being sold at a public auction, warning that serious losses loom, should the court proceedings drag for a long period of time.
In a disclosure to the Philippine Stock Exchange, Jose Marcel E. Panlilio, the company’s chairman, said the firm recently discovered that a notice of public auction on its 1,477-square meter Friday’s Resort property has been posted at the lobby of the Hall of Justice in Quezon City.
The writ of execution, which is the preliminary step for its public sale scheduled on March 7, was issued by Judge Edgardo Bellosillo of Regional Trial Court (RTC) Branch 95 in Quezon City.
Boulevard regained control of Friday’s Boracay in March last year.
“Thus, we are filing as third-party claimant [complaint in intervention] at the [RTC in Quezon City], [we] will also go to the Ombudsman for the criminal cases against court persons, [Ambassador Amable] Aguiluz and Mila Yap soon,” Panlilio said in a statement.
The disputed property was awarded by RTC in Makati City to the Panlilio family-led company in 2008 after it had proven the full payment of its purchase price from former owner Mila Yap.
Yap, who, at that time, already knew the finality of such court order, mortgaged the property to Amable Aguiluz for P74 million.
Aguiluz is the country’s special envoy to the Gulf Cooperation Council.
Upon failure to pay for the said debt, Yap and Aguiluz entered into a compromise agreement in the RTC in Quezon City, subjecting the mortgaged property to a public sale. Proceeds of the said sale was supposed to be used as payment for the loan of Yap to Aguiluz.
Panlilio noted the new proceedings, if not intervened with by the firm, will again ruin the company’s investments, as well as the livelihood of its employees.
“We already spent P195 million in two years—by buying more land, paying lawyers and police, and repair for the theft that the armed men did—to save Friday’s Resort. Now, we shall lose more than P14 million a month on a hotel that is 100-percent fully booked until end of May,” Panlilio said.
Boulevard’s main business consists of its hotel, leisure and tourism segment, Friday’s Holdings Inc., the operator of the Boracay resort, which for 13 months was taken over by the former land owners, Mila Yap and Datu Yap, following a land dispute involving a 1,477-sq m beachfront.
“Nevertheless, all of us shareholders are hereby alerted of the suspicious actions of Judge Bellosillo of RTC [branch] 95 in Quezon City and his sheriff Blanco in surreptitiously issuing these orders. Let us see, once they know Friday’s is the named owner on the land parcel, if they had not received anything by their common sense willingness to cancel this imminent fake and illegal auction date done by parties who don’t even own our land,” Panlilio said.

BHI does not own the whole property where Friday’s Boracay Beach Resort is located. They illegally occupied with the coercion of the police and Aklan Sheriff the property of Mila Sumndad without a BREAK in ORDER last March 2015 going against a Court of Appeals order. The Sumndads took back possession of the property in Feb 14, 2014 after the 25 year long term lease ended. In fact, BHI was trying to bribe the son of Mila Sumndad with PhP 95 Million pesos to turn over the property to them. Luckily, mother and son are close and the son did not agree to the offer which happened at the lobby of a posh Manila hotel. BUYERS BEWARE!
