THE Department of Agrarian Reform (DAR) has issued new rules and procedures governing the cancellation of registered emancipation patents (EPs), certificates of land ownership awards (CLOAs), and other titles issued under the Agrarian Reform Program through Administrative Order 07, Series of 2014.
Agrarian Reform Secretary Virgilio de los Reyes said this amendatory administrative order is accordingly issued to highlight the indefeasibility of the EPs, CLOAs, and other titles distributed under Agrarian Reform, emphasize due process in the cancellation proceedings, streamline the cancellation process before the Agrarian Reform secretary, protect the interest of the farmer beneficiaries, and improve the access to justice of farmers before the DAR.
De los Reyes said the new administrative order applies to all cases involving involuntary cancellation of individually registered EPs, CLOAs, and other titles issued by the DAR under any Agrarian Reform Program.
He cited among others the following grounds for the cancellation of EPs, CLOAs, and other titles issued, such as retention area of the landowner; landholding is excluded or exempted from coverage of Comprehensive Agrarian Reform Program, Presidential Decree 27, or any other agrarian reform laws; defective or irregular Notices of Coverage; the landholding falls under the exclusive authority of the Department of Environment and Natural Resources or the National Commission on Indigenous People.
Also, erroneously issued titles; nullification of DAR Clearance; misuse or diversion of financial and support services extended to Agrarian Reform Beneficiaries (ARB); misuse of the land; material misrepresentation of the ARB’s basic qualifications; premature conversion by ARB.

Dear sir at the DAR, a step brother Bedong borrowed a total of P350 to repair his house because it was nlown off by a Philippines’ hurricane Kuno, (plus hospitalisation bill of P10 he cant go home withiut paying the bill). He made a promisorry mote drafted by his solicitor then signed by his witnesses and wife that In case he failed to pay his loan he will pay me with his 1 hectare ricefield. Cut long story short; the said land has awarded me the land. However my crafty solicitor has scammed me; he failed to fulfill his promise to see that the title is clean; my step brother named 1000 sqm each to his two daughters with a payment of P5.00 pesos only each on the same date he received the money from me. Plus my other step brother Masong is claiming that he has cultivated the land for iver 30 yrs so he claims it belongs to him. Plus Bedong put another tenant cultivating the 2000 sqm which he transfered into his two daughters. This 2000sqm tenant is slowly moving the Pilapil/division so every now and then the two farmers argue whenever they are both in the field! It scares me because both if them cary Bolo/Itak!!! I feel so frustrated I had spent so much money for that solicitor plus my nephew whom I had given power of attorney to attend hearing on my behalf. So it looks like my solicitor Skinned me alive and Bedong’s wife who attended the numerous days of hearing just enjoyed the drama knowing fully well that I will never get anything from it! It is not fair that I had to pay 15 yrs of tax when I cant even transfer it in my name! So where do I go from here; I am an old OFW and I am Skint/bankcrupt people had scammed me!

If nacancel po yan title ni lola. Dapat my due process. D pwede outright cancel agad. Due process, meaning dapat my hearing sa cancellation. Ang tanong, my mga hearing ba na attenan si lola? Next is dapat my order of cancellation letter galing sa dar na natanggap ni lola. Pag wala, illegal ang cancellation. Punta kayo sa ROD ng place san located ang lupa ni lola. Ask niyo by virtue of anong order kung bakit na cancel ang lupa ni lola.

Gaano po katagal ang pag process ng EP, may utang po sa Tax Dec. and willing naman po na bayaran ng lahat ng utang, at paano po ang processo para ma release ang TCT sa owner ng EP?
