  • AMWSLAI dispute resolved

    THE Supreme Court (SC) has resolved the leadership dispute in the P14-billion Air Materiel Wing Savings and Loan Association Inc. (AMWSLAI) of the Air Force by simply noting and taking no action on the urgent motion filed by erstwhile AMWSLAI directors.

    The motion by Luvin Manay, Antonio Mantuano, Jose Elaurza, Johnson Ocfemia and Anselmo Geronimo sought to annul the results of the January 18, 2008, election of the board.

    Based on SC’s traditional practice, the “noted” or “to note” action done by the tribunal means the court merely accepted the pleading filed and saw no necessity in further acting on it.

    Besides “noting” the filing by Manay’s group, the SC granted the motion for leave to admit the opposition to the plea to annul the elections filed by the board.

    Among the new directors are retired Col. Ricardo Nolasco Jr, as board chairman and president; Thaddeus Estalilla, Morado Mercado, Ismael Abad, Ricardo Perido, Angel Tapac, Antonio Gumba and Cesar Toledanes,
    members. The October 9, 2007 decision written by Justice Antonio Eduardo Nachura annulled the results of the 2005 elections and ordered the reinstatement of Nolasco, Estalilla, Mercado, Manay, Mantuano, Elaurza, Ocfemia and Geronimo as holdover directors,  but only until the election and proclamation of winners in a “valid, lawful and orderly election.”

    In a manifestation filed by their counsel J. Oswald B. Lorenzo for the new board, the High Court was informed that such an election was held in accordance with the High Court’s decision. 

    Lorenzo said Manay, Mantuano, Elaurza, Ocfemia and Geronimo were officially notified of the January 18 elections, but that they did not participate.
